1. Acceptance of Terms

By accessing or using Lyrical Listings’ services—including ordering, purchasing, or viewing customized music videos—you agree to be legally bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these terms, please refrain from using our services.

2. Description of Services

Lyrical Listings LLC provides customized marketing videos for real estate professionals that incorporate property images, videos, and professionally produced or licensed music. These videos are tailored for online marketing, social media, and listing promotions. Optional add-ons may include agent branding, custom voice overs, or licensed audio tracks.

3. Eligibility

Our services are intended for users who are 18 years or older and authorized to represent or promote real estate properties. By placing an order, you confirm that you have the legal authority to use the media provided and to market the property depicted in the video.

4. Intellectual Property & Usage License

All content created by Lyrical Listings (including video edits, scripts, lyrics, narration, and musical elements) is owned by Lyrical Listings LLC unless otherwise agreed in writing.

Upon full payment, you are granted a limited, non-exclusive, non-transferable license to use the final video strictly for marketing purposes related to the property or your personal real estate brand. You may not resell, sublicense, or alter the video without prior written consent. Unauthorized use of our content may result in legal action.

Marketing Use License

By engaging Lyrical Listings LLC to produce video content, the client hereby grants Lyrical Listings LLC a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, display, distribute, and publicly perform any and all final video productions, in whole or in part, for its own promotional and marketing purposes. This includes, but is not limited to, display on the Lyrical Listings website, social media accounts, digital advertisements, email campaigns, marketing presentations, and other promotional materials.

Lyrical Listings LLC shall have the right to reference the client’s name, branding, and any included property visuals or likenesses solely in connection with such promotional use. If a client wishes to opt out of promotional usage for a specific project, a written request must be submitted at the time of ordering. Absence of such a request will be deemed acceptance of this usage clause.

5. Client Responsibilities

You agree to:

Provide all necessary assets (photos, video clips, property details) and approvals in a timely manner.
Ensure you have the legal right to use and distribute all media and property content provided to us.
Review and approve content before final delivery, as revisions may incur additional fees.

We are not responsible for any legal claims arising from the unauthorized use of content you provide, including copyright violations or privacy claims from individuals shown in your media.

6. Third-Party Rights and Music Licensing

If you request specific third-party music to be included in your video, you are responsible for obtaining all necessary rights or licenses. Lyrical Listings provides royalty-free or original music unless otherwise arranged.

We are not liable for claims related to unauthorized third-party materials or media you supply.

7. Payment Terms & Refund Policy

All orders must be paid in full upfront unless otherwise agreed. Due to the custom nature of our services, all sales are final. However, if there is an error on our part, we will correct it promptly at no additional cost.

Two rounds of revisions are included only if requested within two business days of delivery. Additional edits or reworks may require additional fees at a cost of $25.00 per round of edits.

8. Turnaround Time

Our standard production turnaround is 24–48 business hours from the time we receive all required assets and approvals. This includes the listing address, property description, and media files.

Delays caused by missing information, late submissions, or excessive revisions are not our responsibility. If any of the required assets are not provided, the 24–48 hour timeline no longer applies. In such cases, production will begin only after all necessary materials are received.

9. Disclaimers

We do not guarantee results, lead generation, property sales, or engagement metrics from our videos. Our content is a marketing tool, and performance may vary depending on market conditions and distribution strategy.

Content is delivered “as-is” and without warranties of any kind, either express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, Lyrical Listings LLC and its owners, employees, and contractors shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or reputational harm, arising from your use of our services.

Total liability, if any, shall be limited to the amount you paid for the specific video project in question.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lyrical Listings LLC from any and all claims, damages, or liabilities (including attorney’s fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Dispute Resolution

Any disputes or claims arising out of these Terms shall first be resolved through good faith negotiation. If resolution is not reached within 30 days, both parties agree to submit the dispute to binding arbitration in Alachua County, Florida, under the rules of the American Arbitration Association. You waive your right to a jury trial or class action.

13. Termination

We reserve the right to refuse service, cancel projects, or terminate access to our services at our discretion, particularly in cases of misuse, non-payment, or violations of these Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

Refund Policy

To be eligible for a full refund, the following conditions must be met:

Property Registration & Promotion
You must register your home with Lyrical Listings and publish the delivered video on at least three social media platforms and the MLS within 3 days of purchase.
Minimum Visibility Period
The video must remain live and publicly accessible on those platforms for at least 60 consecutive days before submitting a refund request.
Listing Status
If your property receives an offer, goes under contract (pending), or is sold before or during the 30-day refund review period (which starts after you request a refund), the refund will no longer be eligible.
Refund Window
Refund requests must be made within 90 days of the video delivery date. Requests made after this period are not eligible.
Processing Time
Once your refund request is approved, please allow up to 30 days for processing. If your home receives an offer, goes pending, or is sold during this 30-day period, the refund will be canceled.
